Why Rights Management Is Wrong

Order Number: 2001-002

This technical note argues that digital rights management (DRM) based on strict enforcement is ineffective and doomed to fail due to the nature of digital copying. The author asserts that trying to prevent digital piracy through hardware restrictions or technology is impractical and counterproductive. Instead, the document proposes an alternative model inspired by shareware licensing, where creators sell licenses to customers and leverage peer-to-peer distribution as a marketing tool. The paper details how such a licensing system could work using digital signatures, notarization, and RDF-formatted terms to balance the needs of content creators and users.
